Welcome to McRolly Staffing Agency (“the Agency,” “we,” “us,” or “our“). These Terms and Conditions (“Terms“) govern your access to and use of our website https://mcrollystaffing.com (the “Site“) and all related services, content, and functionality (collectively, the “Services“).

By accessing our Site, creating an account, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Site or Services.

2. Definitions

  • Candidate” or “Job Seeker” refers to an individual user seeking employment through our Services.

  • Client” or “Employer” refers to a corporate or organizational user seeking to recruit candidates through our Services.

  • User” refers to any visitor, Candidate, or Client using the Site or Services.

  • Content” refers to all text, graphics, images, software, and information on the Site.

3. User Accounts and Registration

  • To access certain Services, you must create an account and provide accurate, current, and complete information.

  • You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.

  • You agree to notify us immediately of any unauthorized use of your account.

  • We reserve the right to suspend or terminate your account at our sole discretion if we suspect any fraudulent, abusive, or illegal activity.

4. Services Description
McRolly Staffing Agency provides a platform connecting Nigerian job seekers with international employment opportunities. Our Services include, but are not limited to:

  • Job search and matching for Candidates.

  • Candidate sourcing and vetting for Clients.

  • Facilitation of the application and interview process.

  • Guidance on visa application procedures (Note: We are not immigration lawyers).

  • These Services are subject to separate, detailed Service Agreements for Candidates and Clients, which will supersede these general Terms.

5. Candidate Terms

  • Eligibility: You must be at least 18 years old, possess a valid international passport, and have the legal capacity to enter into a contract.

  • Accuracy of Information: You warrant that all information provided (including on your CV, profile, and application) is true, accurate, and not misleading. We reserve the right to terminate our services immediately if false information is provided.

  • Service Fee: Access to our job placement services for Candidates is subject to a refundable service fee, as detailed in our separate Refund Policy for Job Seekers and the specific Service Agreement.

  • No Guarantee: You acknowledge that we provide placement services, not a guarantee of employment. The final hiring decision rests solely with the Employer.

6. Client Terms

  • Job Postings: Clients are responsible for the accuracy and legality of their job postings, including compliance with all applicable labor and anti-discrimination laws.

  • Candidate Information: Candidate information shared by the Agency is confidential and is to be used solely for the purpose of evaluating the candidate for the specified job opening. It may not be shared with third parties or used for any other purpose without the candidate’s and Agency’s consent.

  • Fees & Guarantee: Client placement fees and any applicable guarantees are outlined in a separate Client Engagement Agreement and are subject to our Refund & Guarantee Policy for Employers.

7. Intellectual Property Rights

  • The Site, its original content, features, functionality, and logos are the exclusive property of McRolly Staffing Agency and are protected by international copyright, trademark, and other intellectual property laws.

  • You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial use. You must not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

8. User Conduct
You agree not to use the Site or Services to:

  • Upload or transmit any content that is unlawful, abusive, threatening, or defamatory.

  • Impersonate any person or entity.

  • Engage in any activity that compromises the security or functionality of the Site.

  • Use any data mining, robots, or similar data gathering tools.

  • Solicit our users for any commercial purpose outside the intended use of our Services.

9. Payment Terms

  • All fees are as quoted on the Site or in your Service Agreement and are exclusive of any applicable taxes.

  • Payments must be made in full via our designated payment channels before certain services are initiated.

  • We use third-party payment processors, and you agree to their terms and conditions by using their services.

10. Disclaimer of Warranties and Limitation of Liability

  • The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

  • We do not guarantee uninterrupted, secure, or error-free operation of the Site.

  • To the fullest extent permitted by law, McRolly Staffing Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangibles, resulting from your use of the Site or Services.

  • Our total liability to you for any claim shall not exceed the total amount of fees you have paid to us in the six (6) months prior to the event giving rise to the claim.

11. Indemnification
You agree to indemnify, defend, and hold harmless McRolly Staffing Agency and its officers, directors, employees, and agents from any claim, demand, damage, or loss (including reasonable attorneys’ fees) made by any third party due to or arising out of your use of the Site, violation of these Terms, or violation of any rights of another.

12. Third-Party Links
Our Site may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. You access them at your own risk.

13. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

  • Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, the dispute shall be referred to mediation in Lagos, Nigeria. If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts located in Lagos, Nigeria.

14. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of changes by posting the updated Terms on the Site and updating the “Last Updated” date. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
