Refund Policy for Job Seekers

1. Introduction
This Refund Policy outlines the terms and conditions under which McRolly Staffing Agency (“the Agency,” “we,” “us,” or “our”) provides refunds for the service fees paid by job seekers (“Candidates,” “you,” “your”) for our job placement services. This policy is an integral part of our Service Agreement. By engaging our services and making a payment, you acknowledge that you have read, understood, and agreed to this policy.

2. General Principle
Our service fee is refundable under specific conditions, as detailed below. The fee is charged for the active provision of our placement services (sourcing jobs, arranging interviews, providing support) and not solely for the guaranteed outcome of a job offer.

3. Refund Eligibility Conditions
Refunds are processed based on the plan you selected and the following scenarios:

1. No Job Offer Full Refund If the Agency fails to secure a verifiable job offer for you within 180 days (6 months) from the effective date of our signed Service Agreement.
2. Voluntary Withdrawal Partial Refund If you decide to withdraw from our service after we have secured at least one interview for you but before a job offer is made. A non-refundable administrative fee of 20% of the total fee will be deducted to cover costs incurred.
3. Service Not Rendered Full Refund If, for any reason, the Agency is unable to commence service provision after payment is received.
4. Plan Downgrade Partial Refund If you request to downgrade to a cheaper plan before any service for the higher plan has been initiated, the price difference will be refunded.

4. Non-Refundable Scenarios
The service fee becomes non-refundable under the following circumstances:

  • Job Offer Rejection: You reject a legitimate job offer from an employer we introduced that matches your stated qualifications, experience, and salary expectations.

  • Candidate Failure: You fail an interview, assessment, or test administered by the potential employer.

  • Failed Requirements: A job offer is revoked or a visa is denied due to your own actions, including but not limited to:

    • Providing false, inaccurate, or misleading information to us or the employer.

    • Failing a mandatory medical examination.

    • Failing to provide necessary documentation for the visa process in a timely manner.

  • Rescinded Acceptance: You obtain a job offer through our services but voluntarily decide not to proceed with the employment for any reason.

5. How to Request a Refund

  1. Submit a Request: All refund requests must be submitted in writing via email to [refunds@mcrollystaffing.com] with the subject line “Refund Request – [Your Full Name]”.

  2. Provide Details: The email must include:

    • Your full name and contact information.

    • Your service agreement reference number.

    • A detailed reason for the refund request.

    • Any supporting documentation.

  3. Agency Review: Our team will review your request against the terms of this policy and our service agreement. We may contact you for additional information. You will receive a decision via email within 14 business days of receiving all required information.

6. Refund Processing

  • Approved refunds will be processed within 30 business days from the date of approval.

  • Refunds will be issued only to the original payment method or bank account used for the initial transaction. We cannot issue refunds to third parties.

  • All bank charges or transaction fees incurred during the refund process will be borne by the Candidate and may be deducted from the refund amount.

Refund & Guarantee Policy for Employers

1. Introduction
This policy outlines the guarantee and terms for replacement or refund provided to employers (“Clients,” “you,” “your”) who hire a candidate through McRolly Staffing Agency’s (“the Agency,” “we,” “us”) services. This policy is part of our Client Engagement Agreement.

2. General Principle
We stand behind the quality of our candidates. Our goal is to provide you with qualified, pre-vetted individuals who are a strong fit for your organization. If a placed candidate leaves your employment voluntarily or is terminated for performance reasons within a specified guarantee period, we will provide a replacement or a prorated refund.

3. Standard Replacement Guarantee
We offer a 90-day (3-month) guarantee period from the candidate’s official start date of employment.

4. Terms of the Guarantee
The guarantee is subject to the following terms and conditions:

  • The Client must have paid the full placement fee/invoice as agreed.

  • The Client must notify the Agency in writing within 7 calendar days of the candidate’s termination or resignation.

  • The Client must provide a written reason for the separation, and it must be for reasons other than:

    • Layoffs, downsizing, or company restructuring.

    • Changes in the role’s requirements or terms that differ significantly from the original job description.

    • Unlawful termination or violation of labor laws.

    • Hostile work environment or misconduct by the Client.

  • The guarantee is void if the Client fails to pay the candidate the agreed-upon salary or breaches the employment contract.

5. Options Under the Guarantee
Upon valid invocation of this guarantee, the Client can choose one of the following two options:

  • Option A: Free Replacement

    • We will initiate a new search to find a suitable replacement candidate at no additional charge.

    • The standard guarantee period for the replacement candidate will be 45 days.

  • Option B: Prorated Refund

    • If a replacement is not desired or feasible, we will issue a prorated refund of the placement fee.

    • The refund amount is calculated based on the number of days the candidate worked during the 90-day guarantee period.

    Refund Formula:
    (Placement Fee) x [(90 - Days Worked) / 90] = Refund Amount

    • *Example: If the fee was ₦300,000 and the candidate worked for 30 days, the refund would be: ₦300,000 x [(90-30)/90] = ₦300,000 x (60/90) = ₦200,000.*

6. How to Invoke the Guarantee
To invoke this guarantee, the Client must:

  1. Send a written notice to their dedicated account manager or to [clientsupport@mcrollystaffing.com].

  2. Provide the candidate’s full name, start date, and last day of employment.

  3. Provide a copy of the candidate’s resignation letter or a written statement from HR outlining the reason for termination.

7. Exclusions
This guarantee does not cover:

  • Contracts for temporary, fixed-term, or project-based placements (unless otherwise agreed in writing).

  • Situations where the Client hires the candidate for a different position than the one originally agreed upon with the Agency.

  • Candidates who are reduced to part-time status or have their hours significantly reduced.
